Its glad to note that the business climate in India and particularly our State is now global friendly and fast improving and because of the progressive measures being taken by the Central Government and the State Government, there is large scope of increase in trade, commerce and industry within the State.

As the trade, industry and commerce improve, it is natural that disputes and differences are also bound to arise within and between the business class and customers, both domestic and international. It is our strong desire that the Chamber should extend active role in resolving the disputes time boundly in which the members of the Chamber also are involved.

A mechanism for more speedy and less expensive resolution of such disputes is a dire necessity for maintaining healthy relation between the parties to the dispute. To that end, the Supreme Court and all other courts in the country have been promoting Alternative Dispute Resolution (ADR) mechanism by way of mediation, conciliation and arbitration.

KCCI has constituted “Arbitration Conciliation Mediation Council (KCCI-ACMC)”. We have adopted our own arbitration/conciliation/ mediation clause which could be introduced by the members of the Chamber in to incorporate the Arbitration Clause given below in all their agreements and supply orders/work orders and all other documents having commercial aspects with their counter parts so that in case of any dispute or litigation, the same could be resolved with the help of the Chamber.

“Any dispute or difference or claim arising out of or in relation to this contract, including the construction, validity, performance or breach thereof shall be settled and decided by arbitration in accordance with the Rules of Arbitration, Conciliation & Mediation of the KCCI and the award made in pursuance thereof shall be binding on the parties.”
